Terms And Conditions

  

1. Definitions

“Company” means Gasmech Services Ltd, registered in England and Wales, company number 16419618, whose registered office is at Kempston, Mill Hill, Edenbridge, TN8 5DQ.
“Customer” means any individual, company, organisation, or agent requesting or receiving services from the Company.
“Services” means all heating, plumbing, gas, mechanical, installation, repair, servicing, and maintenance works provided by the Company.
“Contract” means the agreement between the Company and the Customer for the provision of Services and/or supply of goods or materials.

2. Scope of Work

2.1 The Company will perform Services as detailed in its quotation, estimate, or order confirmation.
2.2 Any variation or additional work requested by the Customer must be agreed in writing and may be subject to additional charges.
2.3 The Company reserves the right to refuse or withdraw Services where conditions are unsafe, access is restricted, or the requested work is deemed unsuitable or non-compliant with current regulations.

3. Quotations and Estimates

3.1 All quotations are valid for 30 days unless otherwise stated.
3.2 Quotations represent a fixed price for the described works. Estimates are approximate and may vary based on findings once works commence.
3.3 The Company will inform the Customer of any additional costs arising from unforeseen circumstances such as concealed defects, asbestos, corrosion, or pre-existing faults.
3.4 Written acceptance of the quotation or commencement of works constitutes acceptance of these Terms and Conditions.

4. Pricing, Deposits and Payment

4.1 All prices are exclusive of VAT unless stated otherwise.
4.2 For high-value or large-scale works, the Company reserves the right to request either:
 - A deposit of 20% of the total quoted price, payable before works commence; or
 - A valid purchase order (PO) issued by the Customer confirming authorisation to proceed.
4.3 Deposits are non-refundable once materials have been purchased or allocated to the project.
4.4 Payment terms:
 - Domestic Customers: Payment due immediately upon completion of works unless otherwise agreed in writing.
 - Commercial Customers: Payment due within 14 days of the invoice date unless otherwise agreed.
4.5 The Company reserves the right to charge interest on overdue accounts at 8% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
4.6 Materials and equipment supplied remain the property of Gasmech Services Ltd until full payment has been received.
4.7 The Company may suspend further work or deliveries if payment is not received as agreed.

5. Access and Site Conditions

5.1 The Customer must provide safe, reasonable access to all areas where work is to be carried out.
5.2 The Company will not be held responsible for delays, costs, or damage resulting from restricted access, poor site conditions, or inaccurate information supplied by the Customer.
5.3 Gasmech Services Ltd accepts no responsibility or liability for any existing structural, building, or foundational defects at the Customer’s premises, including issues uncovered during the course of the works. We strongly advise that the Customer arranges a survey of the building and its services by a suitably qualified professional prior to any work taking place.
5.4 Where works cannot be completed due to Customer inaction or site issues, a call-out or re-attendance charge may apply.

6. Customer Obligations

6.1 The Customer must ensure the premises are ready for the Company to carry out its work and that any required permissions, licences, or consents have been obtained.
6.2 The Customer must not interfere with the work or request unauthorised variations.
6.3 The Customer is responsible for protecting household contents, flooring, and décor. While the Company will take reasonable care, it cannot accept liability for unavoidable dust or minor disturbance.
6.4 The Customer shall ensure that there is a responsible adult present during works at domestic properties.

7. Warranties and Guarantees

7.1 Gasmech Services Ltd guarantees its workmanship for 12 months from the date of completion unless otherwise stated.
7.2 Manufacturer warranties apply to materials and appliances supplied, subject to the manufacturer’s own terms and registration requirements.
7.3 This guarantee excludes:
 - Damage or faults caused by misuse, neglect, tampering, or interference by others.
 - Wear and tear, consumable items (e.g. filters, seals, fuses).
 - Work where payment has not been made in full.
7.4 The Company’s liability under this guarantee is limited to the repair or replacement of defective workmanship or materials supplied by the Company.
7.5 Guarantee work will only be carried out during normal working hours.

8. Gas, Heating, Plumbing and Mechanical Works

8.1 All gas works are undertaken by Gas Safe registered engineers in accordance with UK law and Gas Safe Regulations.
8.2 The Company will issue the appropriate certification upon completion of gas, heating, or mechanical installations where required.
8.3 The Company accepts no liability for existing defects in systems, pipework, appliances, or water pressure.
8.4 Where pre-existing issues are discovered, remedial work will be advised and charged separately.
8.5 Design Responsibility: Gasmech Services Ltd carries out installations in accordance with the information, drawings, and specifications provided by the Customer or their representative. The Company is not responsible for any design faults, omissions, or inadequacies in the system design, layout, or specification. Where the Customer is uncertain about the suitability or compliance of a proposed design, Gasmech Services Ltd strongly advises that independent guidance is sought from a qualified and appropriately accredited design consultant before any works proceed.

9. Annual Service and Maintenance Agreements

9.1 Gasmech Services Ltd offers service plans and maintenance agreements for both domestic and commercial customers.
9.2 Service plans cover only the equipment and systems specifically listed within the agreement and are valid only while payments are up to date.
9.3 Missed or delayed payments may result in suspension or cancellation of cover.
9.4 Maintenance contracts do not include repairs caused by misuse, third-party damage, or faults resulting from parts or systems not covered under the agreement.
9.5 The service agreement will become void immediately if:
 - Any person, engineer, or company other than Gasmech Services Ltd carries out work, repairs, or modifications to the equipment covered under the agreement; or
 - Any third-party work affects, damages, or interferes with the operation or performance of the covered equipment or system.
9.6 Annual services will be scheduled at mutually convenient times. Missed appointments without 72 hours’ notice may incur a charge.

10. Call-Outs and Emergency Works

10.1 Emergency call-out rates apply outside normal working hours (Monday–Friday 8:00am–5:00pm, excluding public holidays).
10.2 Minimum call-out charges apply and include the first hour of labour. Additional time and materials will be charged thereafter.
10.3 The Company will use reasonable endeavours to respond promptly to emergency requests but accepts no liability for delays caused by circumstances beyond its control.

11. Cancellation and Postponement

11.1 The Customer may cancel or postpone scheduled work by giving at least 72 hours’ notice in writing (excluding weekends and public holidays).
11.2 Cancellations or postponements made with less than 72 hours’ notice may incur a charge to cover lost time, administration, and other associated costs.
11.3 If materials or equipment have already been purchased, ordered, or allocated to the job prior to cancellation, the full cost of those materials will remain payable by the Customer, regardless of notice period.
11.4 The Company reserves the right to postpone or cancel works due to unforeseen circumstances, safety concerns, or supply issues, with as much notice as reasonably possible.

12. Liability and Insurance

12.1 Gasmech Services Ltd holds full public liability insurance and employers’ liability insurance appropriate to its business activities.
12.2 The Company shall not be liable for indirect, consequential, or financial loss arising from delays, breakdowns, or defects unless caused by negligence.
12.3 Nothing in these Terms excludes liability for death or personal injury resulting from the Company’s negligence or any other liability which cannot be excluded by law.

13. Force Majeure

The Company shall not be liable for delay or failure to perform its obligations due to events beyond its reasonable control, including but not limited to extreme weather, strikes, supplier delays, power failures, or equipment breakdown.

14. Complaints and Dispute Resolution

14.1 The Company aims to resolve all complaints quickly and fairly.
14.2 Complaints should be submitted in writing to info@gasmechservices.co.uk or by post to Gasmech Services Ltd, Kempston, Mill Hill, Edenbridge, TN8 5DQ.
14.3 The Company will investigate and respond within 10 working days.
14.4 If the Customer remains unsatisfied, the matter may be referred to an independent dispute resolution body or relevant trade association (e.g. Gas Safe Register or CIPHE).

15. Data Protection and Privacy

15.1 Gasmech Services Ltd complies with the UK GDPR and Data Protection Act 2018.
15.2 Customer data is collected only for legitimate business purposes and will not be shared with third parties except as required to fulfil contractual or legal obligations.
15.3 Customers have the right to request access to, correction of, or deletion of their personal data.

16. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts.

17. Acceptance

By requesting or accepting a quotation, instructing works to proceed, or allowing Gasmech Services Ltd to commence work, the Customer is deemed to have accepted these Terms and Conditions in full.

18. Subcontractors

18.1 From time to time, Gasmech Services Ltd may engage approved subcontractors to carry out part or all of the Services.
18.2 All subcontractors used by Gasmech Services Ltd will be pre-approved and required to hold the relevant qualifications, trade accreditations, and insurances necessary to perform the works contracted for.
18.3 Subcontractors shall operate as independent contractors, and while Gasmech Services Ltd will use reasonable care in their selection and coordination, the Company accepts no responsibility or liability for the actions, omissions, workmanship, or negligence of any subcontractor or their employees.
18.4 Any issues or defects arising directly from subcontractor works will be referred to the subcontractor for resolution under their own terms, guarantees, and insurance cover.

19. Hire Equipment

19.1 Any hire equipment used by Gasmech Services Ltd will be sourced from approved suppliers only.
19.2 All hire equipment must be supplied with valid certification or documentation proving that it is safe, compliant, and suitable for the intended use.
19.3 Prior to use, all hire equipment will be inspected by the operative to ensure it is in safe working condition.
19.4 Gasmech Services Ltd accepts no liability for hire equipment that has not been supplied by an approved supplier or for any failure of equipment due to misuse after inspection.
19.5 Any damage caused to hire equipment while on the Customer’s property will be charged to the Customer at full replacement or repair cost.
